Overview

Procurement of legal services to advise and represent the Castle Control Board in defending an ex parte mandament van spolie application. Open to suitably qualified law firms or practitioners with litigation experience, professional indemnity, and compliance with tax/CSD requirements. Requirements

• Qualified legal practitioner or law firm; experience in court representation and civil procedure.
• Compliance with tax legislation; SARS tax clearance and ongoing tax status disclosure during the contract; registration on the Central Supplier Database (CSD).
• Pre-qualification documents to submit: SBD 1, Tax Clearance Certificate, Pricing Schedule, SBD 4, SBD 6.1, SBD 8, SBD 9, CSD report, Company Registration Certificate, B-BBEE certificate or sworn affidavit, 3 reference letters, proof of banking details, Legal Practice Council registration, practising certificates, CVs of attorneys, professional indemnity/insurance, list of similar matters, and related disclosures.
• Contract is a once-off engagement; Service Level Agreement to be concluded post-award.
• Sub-contractors: disclose and declare percentage of work; ensure each sub-contractor complies.
• Compliance, anti-fronting, confidentiality, and governance terms apply; adverse disclosures may affect award.
