Overview

Requirements

• Eligibility and JV: private entity, state-owned entity, or JV; JV members jointly liable; representative named; max JV size per TDS. Public officers not eligible. Conflicts of interest prohibited. Debarment check required.
• Local content and nationality: foreign bidders must source ≥40% of inputs from Kenyan suppliers/contractors; NCA registration before contract signature; tax clearance; possible exemption for JV under Competition Act.
• Compliance and ethics: no fraud, corruption, or collusive practices; adhere to PPRA and other acts; provide Independent Tender Determination certificate if applicable.
• Documentation and forms: Form of Tender; tender security; joint venture agreement or letter of intent; technical proposal; schedules with priced Bill of Quantities.
• Financials and validity: tender price in Kenyan Shillings; tender validity as per TDS; tender security amount KSh 100,000; site visit and pre-tender requirements.
• Site and pre-tender: mandatory site visit 21 Oct 2026 at 10:00 (Ngoni Earthdam); pre-tender clarification process and possibly pre-tender meeting; minutes published; addenda via web.
• Others: English language, site inspection at own cost, local content and environmental compliance as per tender documents.
