Requirements

• Compliance with Public Procurement and Asset Disposal Act 2015 (anti-corruption declarations) and the Certificate of Independent Tender Determination; not debarred.
• Eligibility and qualifications: JV rules (joint ventures must nominate a representative and be jointly liable); Manufacturer’s Authorization if the tenderer does not manufacture the goods; tax clearance as applicable; evidence of eligibility to tender and to perform the contract.
• Goods eligibility and conformity: origin declarations for goods; conformity to Section VII specifications; provide spare parts, tools, etc., as required.
• Local/ Kenyan content: certain items must be sourced from Kenya (and substitutions from foreign sources are restricted for listed categories).
• Financial/price rules: tender prices fixed (no adjustments unless allowed by the TDS); proper price schedules, separate pricing per lot/item; mandatory tender security where required.
