Overview

Procurement: appointment of a panel of legal service providers for a period of 5 years. Suitable bidders are private law firms registered with the Legal Practice Council, with professional indemnity and fidelity fund insurance, compliant with tax, BBBEE, and TV license requirements, and able to provide legal services across multiple areas of law on an as-needed basis (e.g., Administrative/Constitutional, Commercial, Procurement, Competition, IP, Labour, Broadcasting/Media, Tax, Litigation).

Requirements

• Proof of valid Legal Practice Council registration; valid Good Standing; Fidelity Fund Insurance; professional indemnity cover per principal.
• SARS PIN for tax matters; BBBEE certificate (SANAS) or annual sworn affidavit for EMEs/QSEs; TV license statement or affidavit.
• Certified company registration, shareholders’ certificates, Directors’ IDs; last 3 years’ audited/reviewed financial statements (or management accounts).
• Tax clearance and CSD registration; sworn statements if EMEs/QSEs; declare no misrepresentation under B-BBEE.
• Mandatory: respond for at least one, up to three areas of law; sign confidentiality and engagement terms; acknowledge pricing on a fixed/firms basis and potential CPI adjustments.
• Maintain/improve the awarded B-BBEE level; comply with anti-fronting provisions.

• Documents to complete/submit: mandatory forms (e.g., SBD 4, 8, 9), SBD 6.1 (PPP), BBBEE documentation, Vendor/CSD registrations, and Annexures B–F. Include last three years’ financials and reference letters per Annexure C/D (as applicable).
• Registrations/pre-qualifications: register on the Centralised Supplier Database (CSD); tax/VAT compliance; TV license status.
